Mini Competition Terms and Conditions

Mini Competition Terms and Conditions

  1. For the purposes of these Terms and Conditions, "The Promoter" refers to Stjarnagloss, a trading name of Dodo Juice Ltd, whose Instagram handle is @stjarnagloss. The "Prize" refers to the Stjarnagloss Mini Cooper S previously-used vehicle registration LL04 HXS.
  2. By entering the competition you agree to be bound by these terms and conditions. All entries take the form of one entry being one order made on the Stjarnagloss official website shop at stjarnagloss.com of a paid value of or exceeding 50 GBP (after any discounts etc) made between 1 April 2022 to 30th April 2022. Gratis or discounted orders of a figure below 50 GBP paid will not qualify. Only orders received from 00.01 hours on 01/04/22 to 23.59 hours on 30/04/22 with a valid telephone number in the order contact details will qualify for entry. Multiple entries from a single entrant are acceptable. There will only be one entry per order. The Promoter will deem what entries are acceptable and therefore qualify for the competition and The Promoter may disqualify entries that they deem to be invalid or in bad faith.
  1. Only residents of Great Britain (excluding Northern Ireland) will qualify for entry to this competition. No international entries or orders will be accepted. One (1) winner in Great Britain (excluding Northern Ireland) will be selected by The Promoter on Monday 2nd May at or around 7pm. The winner will be selected on or after this time on this date via telephone communication – entrants must have their telephones turned on at this time and date and be ready to answer a telephone call made by or on behalf of The Promoter to qualify for a chance to win the Prize. If the telephone call is not answered by the entrant to the competition in the manner required by The Promoter (within five rings or until the Promoter or agent of the Promoter ends the call, and only using the phrase required) then the entrant will not be able to win the Prize. Any call going through to a message service or being answered by someone other than the entrant or being left to ring for more than five rings or being answered by the entrant in any other way than by stating the winning phrase required, will be deemed as unqualifying and the entrant and/or call recipient may be removed from the competition at the Promoter’s discretion and will be unable to win the Prize. The required phrase to win the competition will be based on skill/judgment and The Promoter’s decision will be final.
  2. The Promotor’s competitions are open only to residents of Great Britain (excluding Northern Ireland). One (1) winner will be chosen from all entrants.
  3. Entrants must be over 18 years old on the date of their entry.
  4. Employees of The Promoter and their close relations are not eligible to enter. Trade customers of The Promoter (tagged with trade on the Stjarnagloss webshop) are not eligible to enter. Retail customers are only allowed to enter the competition.
  5. Instagram, YouTube and Facebook are not in any way affiliated or involved in the competition.
  6. Orders may qualify for entry without the knowledge of the entrant. Entry is automatic upon meeting the criteria in Clause (3). However, in order to win the Prize the entrant must have enough knowledge of the competition mechanics in order to answer a call made to their order telephone number at the required time/date, in the required manner and then to also be able to successfully answer the relevant competition question using their skill/judgment.
  1. If any entrant fails to meet the criteria needed to win the competition in the opinion of The Promoter then another entrant shall be chosen for a chance to win the competition. There are no runners up prizes or cash alternatives. Entrants who fail to win are not entitled to any compensation or reward.
  2. The Prize will be awarded by The Promoter. Transfer of the Prize to the winning entrant will be made at a time/date after the winner has been chosen within 28 days of the competition closing. If the winning entrant does not want, accept or collect the Prize from The Promoter within 28 days of the competition closing, despite the best efforts of The Promoter to allow for this to happen, or if the winning entrant is uncontactable after 28 days of the winner being chosen despite reasonable efforts of The Promoter to make contact with them, then the Prize will be sold with no reserve on the eBay UK auction platform and the proceeds will go to a charity of the Promoter’s choice. The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled, for example, due to fire or theft of the vehicle before title of the vehicle has been legally transferred to the competition winner.
  1. The Prize is a used vehicle, a second-hand (previously owned and used) Mini Cooper S, registration LL04 HXS. The vehicle has a mileage of over 100,000 miles. There is no cash alternative. The winner of the Prize will be responsible for insuring the vehicle and paying road tax on the vehicle on or before the time/date of collection and for ongoing costs pertaining to the vehicle. No guarantee or warranty is given to the quality of the vehicle, its reliability or safety although it will be presented with a valid MoT certificate. The Prize is a second-hand vehicle of high mileage and should only be accepted as such, caveat emptor. The vehicle may have one or more defects at the time of transfer to the winner. If the winner does not wish to accept the vehicle, it will be disposed of in accordance with Clause (9) by non-reserve auction on eBay UK. The Promoter will not be held liable for removing the vinyl signwriting/livery present on the vehicle. The winner is free to remove the vinyl themselves at their own cost or inconvenience once transfer of the vehicle to the winner has taken place (although The Promoter may allow for the livery to be left on, see Clause (19)).
  2. The Promoter will not be held liable for any failure of receipt of entries or any failure in the required communications processes or communication devices required to win the Prize. The Promoter takes no responsibility for any entries that are incomplete or otherwise invalid.
  3. To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question in accordance with a spreadsheet provided by The Promoter detailing internal costs associated with the Prize.
  4. To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
  5. The Prize is non-negotiable, non-transferable and non-refundable. No cash alternative is available. If the Prize becomes unavailable for any reason, the promoter reserves the right to substitute the prize for a prize of potentially much lower value.
  6. The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfilment of the Prize.
  7. In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
  8. The Promoter's decision is final. No correspondence will be entered into. If the winner is not chosen by The Promoter at or around the stated time and date (e.g. if no winner is found despite making a minimum of 30 phone calls) then the prize will be given away by The Promoter using another mechanism at a later time and date; all qualifying entrants will be re-entered.
  9. The winner’s name and social media username may be posted on the social media profiles of The Promoter after the winner has been selected.
  1. At the discretion of The Promoter, an arrangement may be made between The Promoter and the winner to keep the ‘Stjarnagloss’ vinyl livery/signwriting on the vehicle in exchange for a monthly credit on the Promoter’s Stjarnagloss webshop of no more than 50 GBP per month up to a maximum of 12 months. The credit would be assigned to the winner’s webshop account in arrears (50 gbp per calendar month) on presentation of a date proven image showing that the livery/signwriting is still on the car and in good condition. The vehicle must be driven in a careful and considerate manner and be fully legal in terms of ownership and use throughout the whole term of this arrangement, and if this is not the case, the arrangement and all current and future credits would cease immediately. The arrangement will cease after 12 months from the start of the arrangement or at an earlier time if the Promoter so decides.
